BIA Ignores Supreme Court Decisions
In spite of the decision of the Supreme Court of Serbia, the Security and Information Agency (BIA) didn’t provide, within the legal deadline, the number of people whose communications it wiretapped in 2005, says the Youth Initiative for Human Rights.
"We demand from the Government of Serbia to secure that the decision of the Supreme Court, ordering BIA to provide the Youth Initiative with information on the number of received requests for communications surveillance”, said Andrej Nosov, YI Executive Director and added that the Government is obligated to do so in accordance with the Law on Free Access to Information.
Nosov announced that YI will bring misdemeanor charges against BIA, should the Government decide not the react upon this request. He said that the Youth Initiative was informed about the Supreme Court decision on May 23 of this year, so, it is reasonable to presume that the BIA also received on the same day. The decision orders BIA to provide the sought information within three days upon arrival of the decision. According to Nosov, BIA never fulfilled its obligations.
"We asked from BIA in October 2005 to inform us about the number of persons under surveillance, not their names. The information, however, was classified. If this type of information is confidential, we wonder if anybody has insight in the work of this service, for instance, in procurement of equipment”, said Nosov.
