Civil Platform Protests Proposed Changes in the Law on Associations

The representatives of the Civil Platform of Macedonia used the Parliamentary Office for Contacts with NGOs to present their initiative for changes in the Law on Associations in the 3rd Session of the Parliamentary Committee on Political System and Communities’ Relations of November 1, 2006. The initiative was later submitted for review to all 120 Members of Parliament.

The objections of the non-governmental organizations refer, primarily, to the proposed changes in the Law on Citizens’ Associations and Foundations, and its harmonisation with the Law on Public Registry, as well as the provisions on the role of the Public Prosecutor.

They find the provisions of Article 56 of the Law on Changes and Amendments to the Law on Citizens’ Associations and Foundations, which refers to the role of the Public Prosecutor in the initiative and procedure for termination of non-governmental organizations.

The article is badly written, with many ambiguities, believe some representatives of the civil sector, and may be understood to invest in the Office of the Public Prosecutor the right to terminate NGOs at its discretion.

According to the Initiative, the Ministry of Justice accepted the remarks and objections of civil organizations and will propose the appropriate changes in the amendment debate on the Law, scheduled for the end of this week, or the beginning of next week.

Also, they learned that the Government will work on a completely new legal text which should be completed by the end of February 2007 and submitted to the Parliament for debate and adoption.
