Government Adopts Draft-Law on Environmental Protection

At its session of last week, the Government of Croatia adopted the Draft-Law on Environmental Protection, prepared and submitted by the Ministry of Environment, Spatial Planning and Construction.
This is a so-called umbrella law that regulates, systemically, the basic principles of Croatian legal approach to environmental protection. It will replace the 1994 Law on the Environment, which was the first peace of legislation to regulate issues related to environmental protection. The new law and the implementation documents and regulations it produces, are fully harmonized with EU’s acquis communautaire, a process that should be completed by mid-2008. It fully implements the legal “polluter pays” principle, already implemented in all by-laws adopted so far. The Lay pays special attention to the involvement of general public in decision-making processes on environmental issues, in accordance with the Aarhus Convention, ratified by Croatia in December 2006. The Draft-Law has been available, together with an invitation to make suggestions and comments, on the website of the Ministry, www.mzopu.hr since April 19, 2007. |
