Documenta Demands Additional Investigation on Medacki Dzep Offensive
The Documenta centre demands further investigation on events that took place during the Medacki Dzep offensive in the Homeland War in Croatia, noting that the completed trial at the District Court in Zagreb is an important, yet not sufficient step forward to justice.
Documenta believes that further investigation and trial should uncover the responsible persons in the chain of command and the direct perpetrators of the crimes committed, asking if the State Prosecution shouldn`t have moved to investigate before accepting the charges as presented by the Hague Tribunal for former Yugoslavia.
The Court determined, beyond any reasonable doubt, that crimes were committed durng the Dzep 93 offensive, against civilian population and prisoners of war, but the State Prosecution has not filed any charges against direct perpetrators.
In the rationale it gave for the decision to acquit General Ademi of all charges, and the alleviating circumstances in the case of General Norac, the Court found that Davor Domazet Loso, the Envoy of the Chiefs-of-Staff of the Croatian Army, had greater commanding authority and responsibility than Ademi, and that Ademi and Norac didn`t have command authority over the actions and area of operation of special police forces.
`The Prosecution should investigate the direct perpetrators of the war crimes for which Norac was sentenced for chain-of-command responsibility. Also, the prosecution authorities should investigate the responsibility of the Envoy of the Chiefs-of-Staff, determine individual responsibility for crimes committed in the area of operations of special police, and define the chain-of-command related to the crimes`, concludes Documenta.
