HOTO`s Actions on Cvjetni Trg Illegal

The Right to a City initiative and Zelena akcija (Green Action) environmental organization demand from the authorities to inspect and stop the works on the demolition of the building in the yard of the old printing house on Zagreb`s Floral Square (Cvjetni Trg), believing the works are illegal.

`The investor has tried to present the public with a picture that there are no obstacles to the project and a fait accompli. Quite the opposite, the investor lacks proper location and construction permits, or permit to demolish the Zagreb Theatre and the to buildings facing the street`, legal experts and the two organizations say.

The only permit the investor holds is final, but not legally valid permit to remove the building in yard of the printing press. The permit is not valid because not all legal remedies were exhausted - in fact, there are several administrative appeals against it filed, as confirmed by the analysis conducted by Professor Marko Šikić from the Department of Administrative Law at Zagreb School of Law.

Šikić explains that the investor, the HOTO Group of entrepreneur Tomislav Horvatinčić, holds a permit to remove the said yard-side building, which, unlike the construction permit, doesn`t allow for start of construction works.

`The removed object would be unable to restate to its original status if the court decides to annul the permit. For that reason, all works conducted before the litigation is completed should be deemed illegal`, say the two organizations, accusing the HOTO Group of manipulation with legal terms and provisions.

The Right to a City and Zelena akcija expect from the investor to continue to abuse the complex legal situation. Therefore, they have demanded a proper inspection of the sight by construction and development authorities, expecting to learn if HOTO`s lawyers did a bad job or if the state has decided to take the side of the illegal devastators.
